If Duo Vert is found liable for any loss or damage arising from the use or functions of the Website, its total liability will not exceed $50.00 CAD in the aggregate.

If any provision of these Terms of Use is found to be illegal, void, or for any reason unenforceable by a court of competent jurisdiction, the validity and enforceability of the remaining provisions will not be affected.

These Terms of Use are binding on you, your heirs, executors, beneficiaries, successors, and assigns, and you may not assign these Terms of Use to another party without the prior written consent of Duo Vert, which consent may be withheld at Duo Vert's sole discretion.

Duo Vert will not be deemed to have waived any of its rights or remedies described in these Terms of Use unless the waiver is made in writing and signed by Duo Vert. No delay or omission by Duo Vert in exercising its rights or remedies will impair or be construed as a waiver. Any single or partial exercise of a right or remedy will not preclude any further exercise of any other right or remedy. Duo Vert's failure to insist on strict compliance with any term of these Terms of Use will not constitute a waiver of that term and will not be deemed a waiver or limit its subsequent right to insist on strict compliance with that term or any other term contained in these Terms of Use.
